Ownership of Site; Agreement to Terms of Use

These Terms of Use apply to the Pancake Studio website, web application, and related online services (collectively, the “Site” or “Service”), operated by Pancake Studio from Austria (“Pancake Studio”, “we”, “us”, “our”). The Site provides AI-assisted audio dubbing tools, account management, subscription billing, and related features.

By accessing or using the Site, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the Site.

We may change, modify, add, or remove portions of these Terms of Use at any time at our sole discretion. It is your responsibility to review them periodically. Your continued use of the Site after changes are posted means you accept and agree to the changes. As long as you comply with these Terms of Use, we grant you a personal, non-exclusive, non-transferable, limited right to access and use the Site for its intended purpose.

The Service

Pancake Studio enables you to upload audio content, select target languages, and receive AI-generated dubbed audio through our dubbing pipeline (“Genesis V1” during closed beta). The Service may include Studio library management, job status updates, preview playback, file export, subscription checkout, and transactional email notifications.

Features, delivery times, output quality, and infrastructure capacity may change as we develop the product. Lip-sync and other capabilities described on our marketing pages may be offered on a roadmap basis and are not guaranteed to be available at any specific date unless expressly confirmed in a separate written agreement.

Eligibility and Accounts

You must be at least 16 years old and capable of forming a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

Accounts are created through our authentication provider (Clerk), including sign-in with Google where offered. You agree to provide accurate information and to keep your account details current. You may not share your account, impersonate another person, or create accounts by automated means without our permission.

We may suspend or terminate accounts that violate these Terms, pose security risks, or are used for unlawful purposes.

Subscriptions and Payments

Paid plans (including Starter and Pro) are billed on a recurring subscription basis through Stripe. By subscribing, you authorise us and Stripe to charge your selected payment method at the then-current price until you cancel.

During closed beta, published prices may differ from post-beta standard pricing. If you subscribe during beta at an advertised beta price, that price may remain locked for your active subscription as described on our pricing pages, subject to these Terms and any plan-specific conditions shown at checkout.

You can manage billing, update payment methods, and cancel subscriptions through the Stripe Customer Portal where available. Cancellation stops future billing but does not automatically entitle you to a refund for the current billing period unless required by applicable law.

We do not store full payment card numbers on our servers. Payment processing is handled by Stripe under its own terms and privacy policy.

Closed Beta

Pancake Studio is currently offered as a closed beta. That means features may be incomplete, unavailable, or changed without notice; service may be interrupted; and output quality may vary. Beta access may require manual review and approval of uploads before processing begins.

Beta pricing, delivery targets, and promotional offers are subject to change. We may limit access, queue jobs, or modify capacity to maintain platform stability. Nothing in these Terms guarantees uninterrupted beta access.

User Content and Uploads

You retain ownership of audio and other content you upload (“User Content”). By uploading User Content, you grant Pancake Studio a worldwide, non-exclusive licence to host, store, reproduce, process, transcribe, translate, dub, transform, and deliver that content solely to operate and improve the Service — including running our pipeline on cloud infrastructure and GPU providers.

You represent and warrant that:

you own or have all necessary rights, licences, and consents to upload and dub the User Content;
your User Content does not infringe intellectual property, privacy, or other rights of any third party;
your use of the Service complies with applicable law.

Uploads are subject to technical limits (including a maximum file size of 500 MB per upload unless otherwise stated). Supported formats may be converted internally for processing. You are responsible for keeping your own backups; we are not a long-term archival service.

Acceptable Use

You agree not to use the Site to:

violate any law or third-party rights;
upload content that is unlawful, defamatory, harassing, deceptive, or otherwise objectionable;
clone voices or create deepfakes without the lawful consent of the individuals concerned;
attempt to bypass approval queues, access controls, usage limits, or security measures;
reverse engineer, scrape, overload, or disrupt the Service or its infrastructure;
resell, sublicense, or commercially exploit the Service except as expressly permitted by us.

We may remove content, reject uploads, delay processing, or suspend accounts that we reasonably believe violate this section.

Intellectual Property

All text, graphics, user interfaces, visual interfaces, photographs, trademarks, logos, software, design, and other materials on the Site (excluding your User Content) are owned by Pancake Studio or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Site or its software except as allowed by these Terms or with our prior written consent. “Pancake Studio”, associated logos, and product names are our trademarks or those of our licensors.

Dubbed outputs generated for you are licensed for your use in accordance with these Terms and your underlying rights in the source material. We do not claim ownership of your original User Content.

Review, Approval, and Processing

During closed beta, uploads from standard accounts may enter a pending state until reviewed and approved by authorised Pancake Studio personnel. We may approve or reject uploads at our discretion. Rejected jobs may include an internal or user-visible note explaining the decision where appropriate.

Processing uses automated AI and audio systems. Results may not perfectly match your expectations. You are responsible for reviewing outputs before publication or commercial use.

Delivery Times, Plans, and Limits

Published delivery targets (for example, up to 24 hours for Starter and up to 12 hours for Pro during beta) are goals, not guaranteed service-level agreements, unless we expressly state otherwise in writing.

Plan features may include differences in queue priority, preview access, and export length. Free or unpaid accounts may receive limited preview playback and capped delivery length compared with active paid subscriptions. Current limits are described on our website and in the Studio interface.

Paid plans advertised as “unlimited dubbing” refer to fair use within the Service during your subscription term and are subject to reasonable technical and abuse-prevention limits.

Privacy

Our collection and use of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. By using the Site, you acknowledge that you have read and understood the Privacy Policy.

Disclaimers

The site and service are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, secure, or that dubbed outputs will meet your requirements or be suitable for any particular use. AI-generated audio may contain inaccuracies or artefacts.

Limitation of Liability

To the maximum extent permitted by applicable law, pancake studio and its officers, directors, employees, agents, and suppliers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunity, arising out of or related to your use of the site.

To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months before the event giving rise to the claim, or (b) EUR 100.

Some jurisdictions do not allow certain limitations of liability; in those cases, our liability is limited to the fullest extent permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless Pancake Studio and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms or applicable law.

Termination and Account Deletion

You may stop using the Service at any time. Signed-in users may delete their account through the Studio profile menu, which removes associated job data and authentication records as described in our Privacy Policy.

We may suspend or terminate your access immediately if you breach these Terms, if required by law, or to protect the Service or other users. Upon termination, your right to use the Site ceases, but provisions that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

Governing Law and Disputes

These Terms are governed by the laws of Austria, excluding conflict-of-law rules, except where mandatory consumer protection laws in your country of residence provide otherwise.

If you are a consumer in the European Union, you may also have the right to use the EU Online Dispute Resolution platform. For business users, the courts of Austria shall have exclusive jurisdiction, subject to mandatory legal provisions.

General

These Terms, together with the Privacy Policy and any plan-specific terms shown at checkout, constitute the entire agreement between you and Pancake Studio regarding the Site. If any provision is held invalid, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver of that right.

You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
